Credit Card Statute of Limitations in Pennsylvania

Generally speaking, the Statute of Limitations for Credit Card debt in Pennsylvania is four (4) years.  The bigger question is “When does the Statute begin to run”?

Credit Card collection lawsuits are on the rise across the country. We especially notice the increase in claims here in Pennsylvania based upon the volume of phone calls and emails that I receive on this topic.

One of the biggest questions that I receive is “What is the Statute of Limitations for Credit Card Debt”? The quick and easy answer is four (4) years. (Unless the contract is under Seal, which makes the SOL 20 years. Most Credit Card contracts are not under Seal).

Should I negotiate with a Collection Agency?

Claims or lawsuits that are filed by collection agencies are often legally insufficient.  Why negotiate on a claim that you can win?

Unfortunately, I receive calls from clients who ask this question AFTER they have already begun negotiations with the collection agency. For the most part, as you might guess, I believe that the answer to this question is no.

We first have to take a look at what the collection agency is. There are generally two kinds of collection agencies: 1) Those that work as in-house collectors for a specific company or companies. Their goal is to recover the delinquent amounts due for their parent company; and 2) Those that purchase delinquent debt for the sole purpose of collecting funds for themselves at the highest rate possible.

Preventing Employee Lawsuits

Q: I was a manager at a small company for many years. This company had a couple of lawsuits filed by disgruntled employees. Now I am in the process of establishing my own business. How can I prevent lawsuits by employees?

A: You can’t. Our legal system allows individuals to file lawsuits, meeting a fairly minimal threshold, when they believe they have been wronged. And while employers may and often do ultimately prevail, even winning can represent a significant expense to your company – one that most would prefer to avoid if at all possible.
